SMS Terms and Conditions

These SMS Terms and Conditions (“SMS Terms”) govern the text messaging program offered by MI Pharm LLC., doing business as AMAC Pharmacy Services (“we,” “us,” or “our”).
By enrolling in or otherwise consenting to our SMS program, you agree to these SMS Terms and our Privacy Policy available at www.amacrxs.com
1. Program Description
AMAC Pharmacy Services may send text messages concerning:
- Order, delivery, or service updates
- Customer-service communications
- Account notifications
- Prescription refill reminders
- Requests for information needed to process prescriptions, insurance claims, or account services
- Billing and payment notifications
- Other pharmacy-related informational messages related to services you have requested
2. Consent to Receive Text Messages
By providing your mobile telephone number and affirmatively opting in to the SMS program, you consent to receive recurring text messages from AMAC Pharmacy Services at the mobile number you provided.
Messages may be sent using an automatic telephone dialing system, automated technology, or another messaging platform.
Your consent to receive marketing text messages is not a condition of purchasing any goods or services.
You represent that:
- You are the subscriber or customary user of the mobile number provided.
- You are authorized to consent to receive text messages at that number.
- The information you provide is accurate and complete.
- You are at least 18 years old or have the permission of a parent or legal guardian.
3. Message Frequency
Message frequency may vary based on your interactions with us. You may receive approximately up to 4 messages per month.
Additional transactional or customer-service messages may be sent when necessary to respond to your requests or provide services you requested.
4. Message and Data Rates
Message and data rates may apply.
Your wireless carrier may charge fees for sending or receiving text messages. Charges depend on your mobile service plan and wireless carrier. AMAC Pharmacy Services is not responsible for carrier charges.
5. How to Opt Out
You may cancel and opt out of the SMS program at any time by replying STOP to any text message you receive from us.
After you submit an opt-out request, you may receive one final text message confirming that you have been unsubscribed. After that confirmation, you will no longer receive messages from the applicable SMS program unless you opt in again.
Opting out of text messages does not prevent us from contacting you through other lawful methods when necessary, such as email, telephone, or postal mail.

7. Rejoining the Program
After opting out, you may rejoin the SMS program by completing our opt-in process again or by replying START, where supported.
Your previous consent will not automatically be treated as consent to receive future marketing messages after you have opted out.
8. Supported Carriers and Delivery
Text messaging services are provided on an “as available” basis. Message delivery is subject to the effective transmission by your wireless carrier and mobile network provider.
Wireless carriers are not liable for delayed or undelivered messages.
Delivery may be affected by factors outside our control, including:
- Mobile network availability
- Carrier filtering
- Device compatibility
- Changes to your mobile service
- An inactive or disconnected telephone number
- Technical interruptions
We do not guarantee that every message will be delivered.
9. Changing or Reassigned Mobile Numbers
You agree to notify us promptly if you stop using, deactivate, or transfer the mobile number enrolled in our SMS program.
Before changing, disconnecting, or transferring your number, you should reply STOP to unsubscribe. This helps prevent messages from being sent to a person who later receives your former number.
10. Privacy and Mobile Information
Your participation in the SMS program is subject to our Privacy Policy, available at: www.amacrxs.com
We do not sell, rent, or share your mobile telephone number, SMS opt-in information, or text messaging consent with third parties or affiliates for their marketing or promotional purposes.
We may disclose information to service providers that help us operate and support the SMS program, such as telecommunications carriers and messaging-platform providers. These providers may use the information only to perform services on our behalf and may not use it for their own marketing purposes.
11. Marketing and Informational Messages
Where required, consent to receive marketing messages will be obtained separately from consent to receive informational or transactional messages.
Opting out of marketing messages will not prevent us from sending non-marketing messages that are necessary to complete a requested transaction, provide a requested service, protect an account, or comply with legal obligations, when permitted by law.
12. Prohibited Conduct
You agree not to use the SMS program:
- For unlawful, fraudulent, abusive, or harassing purposes.
- To interfere with the operation or security of the program.
- To impersonate another person.
- To provide a mobile number you are not authorized to use.
- To attempt to gain unauthorized access to our systems or messaging platform.
13. Availability and Modifications
We may suspend, modify, or discontinue the SMS program, in whole or in part, at any time.
We may also change the telephone number or short code used to operate the program. If the number changes, messages sent to a previous number may not be received. We are not responsible for requests sent to a number that is no longer active.
14. Changes to These SMS Terms
We may update these SMS Terms periodically. Changes will become effective when the revised SMS Terms are posted on our website, unless a later effective date is stated.
The “Last Updated” date at the top of this page indicates when these SMS Terms were most recently revised.
Where required by law, we will provide additional notice or obtain renewed consent before making a material change to the SMS program.
15. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the SMS program is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
We do not warrant that the SMS program will be uninterrupted, error-free, secure, or available at all times.
16. Limitation of Liability
To the maximum extent permitted by applicable law, MI Pharm LLC. will not be liable for delayed, failed, or misdirected messages or for damages arising from circumstances outside our reasonable control, including actions or failures of wireless carriers, telecommunications providers, mobile devices, or messaging platforms.
Nothing in these SMS Terms excludes or limits liability that cannot lawfully be excluded or limited.
17. Governing Law
These SMS Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict-of-law principles.
Any disputes arising out of or relating to these SMS Terms or participation in the SMS messaging program shall be resolved in accordance with the dispute resolution provisions set forth in our general Terms and Conditions, if applicable. If no such provisions exist, disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Michigan.
